Columbia Law School Professor Jamal Greene has written a book called How Rights Went Wrong: Why Our Obsession with Rights is Tearing America Apart. Yeah, that sounds like one of those polemics where the titles is all you need to know. But in fact, he suggests ways we can build a better, fairer justice system in America.
He looks at how our sacred “rights” have become divisive and even destruction, as the COVID-19 pandemic has shown. He says that “the system of legal absolutism distorts our law, debases our politics, and exacerbates our differences rather than helping to bridge them” and explores how we can re-think our constitutional rights in a manner that can address 21st-century situations.
